Terms & Policies

Terms and Conditions for JohnsonsFlava LLC

1. Booking and Payment

  • Retainer & Deposit: Your event date is officially reserved upon our receipt of a signed contract and a non-refundable retainer. This retainer includes the cost of the cake/desserts, delivery charges, and a separate equipment deposit.

  • Final Payment: The full remaining balance is due 14 days prior to your event. For weddings, the final payment is due 30 days prior. We reserve the right to waive these terms at our discretion.

  • Last-Minute Orders: Orders placed within one week of the event date must be paid in full at the time of booking and are subject to a $30 rush order fee.

  • Late Payments: If a payment is not received by its due date, the order will be subject to cancellation without refund. A grace period of 2 days may be granted at our sole discretion of Johnsonsflava before cancellation occurs.

2. Liability

  • JohnsonsFlava LLC is not liable for any bodily injury, property damage, or consequential damages that may occur as a result of our services.

  • We are not responsible for any damage to, or shortage of, the cake/dessert once it has been handled by any party not employed by JohnsonsFlava LLC.

  • We reserve the right to withhold delivery if the order has not been paid in full.

3. Fulfillment of Contract

  • JohnsonsFlava LLC shall not be held responsible for delays or a failure to perform caused by circumstances beyond our reasonable control. This includes, but is not limited to, accidents, natural disasters, severe weather, transportation issues, illness, labor disputes, or supply shortages.

  • If a completed order cannot be delivered due to such uncontrollable circumstances, the Client will receive a refund of 10% of the total order cost.

  • If the Client chooses to pick up the order, JohnsonsFlava LLC relinquishes all responsibility for the cake/dessert upon transfer of possession.

4. Postponement and Cancellation

  • The Client must notify JohnsonsFlava LLC immediately of any date change or cancellation.

  • Postponement:

  • More than 14 days before the event: No fee to transfer the retainer to a new date (subject to availability).

  • Within 14 days of the event: A transfer fee of $25 (for orders under $250) or 20% of the order total (for orders of $250 or more) will apply.

  • Cancellation:

  • Cancellations made more than 3 weeks prior to the event will receive a 40% refund of the total order cost, minus the non-refundable retainer.

  • Cancellations made within 3 weeks of the event are not eligible for a refund.

5. Changes to Order

  • All changes to the original order must be requested and confirmed in writing at least 14 days prior to the event. Changes cannot be guaranteed after this deadline.

6. Design

  • We will use our best efforts to create a cake/dessert that closely matches your requested design. Please note that we cannot produce an exact replica of another artist's work but will aim to achieve a similar style and aesthetic.

7. Allergies and Dietary Concerns

  • Our products are prepared in a kitchen that handles common allergens, including but not limited to: eggs, milk, wheat, gluten, soy, and nuts. We also use artificial and natural food colorings and flavorings.

  • The Client assumes full responsibility for informing their guests of all potential allergens. JohnsonsFlava LLC is not liable for any allergic reactions.

8. Delivery, Setup, and Pickup

  • A delivery fee is required unless explicitly waived by JohnsonsFlava LLC.

  • We are not responsible for delays caused by a change of venue communicated less than 3 days before the event.

  • The Client is responsible for providing a stable, suitable environment for the cake (e.g., a cool, level surface away from direct sunlight, heat, or heavy foot traffic).

  • For deliveries, a JohnsonsFlava representative will ensure the cake is placed correctly. The Client must inspect and sign a waiver acknowledging the cake's satisfactory condition. Once signed, we are no longer responsible for any subsequent damage (e.g., collapse, melting, pokes, etc.).

9. General Agreement

  • Your order is very important to us. Please review all details in this contract carefully and notify us immediately with any concerns.

10. Important Disclaimer

  • Our cakes contain internal support structures (e.g., dowels, pillars) for stability. They are not safe for use as a "smash cake." Client expressly agrees not to use the cake for this purpose. JohnsonsFlava LLC is not liable for any injury resulting from the misuse of our products.

11. Service Area

  • We offer delivery within a 15-mile radius of zip code 12180. Shipping is not available. Exceptions to this policy may be discussed and are subject to additional fees.

Johnsonsflava LLC Return & Refund Policy

At Johnsonsflava LLC, we are committed to providing our customers with high-quality products and services. We strive to ensure your complete satisfaction with every purchase.

Due to the perishable nature of our food items and the digital nature of our services, please review our policy carefully.


General Policy for Physical Goods (Non-Food Items):
We accept returns and provide refunds for unopened, unused, and undamaged physical goods (e.g., merchandise, non-food retail items) within 30 days of purchase. The item must be in its original packaging. To initiate a return, please contact us at Johnsonsflava@yahoo.com with your order number and reason for return. The customer is responsible for return shipping costs.

Final Sale Items - No Returns or Refunds:
Please be advised that all sales are final for the following categories. We do not accept returns, offer exchanges, or provide refunds for:

  • Baked Goods (e.g., cakes, pastries, bread, cookies)

  • Desserts (e.g., pies, tarts, cheesecakes, specialty desserts)

  • Prepared Food Items

  • Classes, Workshops, and Tickets to Events

  • Digital Products (e.g., recipes, e-books, guides, downloadable content)

  • Consultation Services (e.g., catering consultations, wedding consultation, custom dessert design sessions)


Why are these sales final?
This policy is in place because our baked goods and desserts are perishable and made to order, ensuring the highest quality and food safety standards. Our classes, digital products, and consultations are intangible services that cannot be returned once purchased or rendered.

Damaged or Incorrect Orders:
Your satisfaction is important to us. If you receive a physically damaged item or an incorrect order, please contact us immediately at Johnsonsflava@yahoo.com within 24 hours of receipt. We will require photographic evidence to process your claim. We will work with you to find a suitable resolution, which may include a replacement or store credit at our discretion.
